MESH01, LLC. (“MESH01”) provides best-in-class testing solutions for every phase of product development (collectively with this website, our “Services”).

This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information from product testers participating in the MESH01 community, as well as our website visitors.

This Privacy Policy does not apply to our handling of personal information of our customers’ own testers. When we administer product tests using our customers’ testers, our processing of those testers’ information is governed by our contract with the customer.

We provide additional information for California users and European residents below.

Personal information we collect

Information we may collect from our product testers. Testers may provide information about themselves or their family members who provide product feedback.

  • Registration details, including your first and last name, email address, mailing address, and phone number.
  • Demographic information, including age, gender, ethnic background, interests and hobbies, profession, and other details (not all of this information is required to participate).
  • Physical characteristics, such as weight, height, shoe and clothing size and preferences, and other characteristics relevant to product testing.
  • Product testing results, including your feedback, images, videos and other information.
  • Communications that we exchange with you, including when you contact us with questions or other feedback.
  • Marketing data, such as your preferences for receiving our marketing communications, and details about your engagement with them.
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Information provided by website visitors, such as contact information and marketing preferences.

Automatic data collection. We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Services, our communications, and other online services, such as:

  • Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G), and general location information such as city, state or geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them.

We use the following tools for automatic data collection:

  • Cookies, which are text files that websites store on a visitor‘s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising. We may use the following types of cookies:
  • Essential Cookies: Essential Cookies are required for providing you with features or services that you have requested. For example, certain cookies enable you to log into secure areas of our Services. Disabling these cookies may make certain features and services unavailable.
  • Functionality Cookies: Functionality Cookies are used to record your choices and settings regarding our Services, maintain your preferences over time, and recognize you when you return to our Services. These cookies help us to personalize our content for you, greet you by name, and remember your preferences (for example, your region).
  • Performance/Analytical Cookies: Performance/Analytical Cookies allow us to understand how users use our Services such as by collecting information on how often a user engages with a particular feature of the Services. We use these aggregated statistics internally to improve the Services, for example, in an effort to make the Services interesting to as many users as possible.
  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

How we use personal information

To operate our Services:

  • Facilitate product testing, and otherwise provide, operate, and improve the Services and our business;
  • Understand your needs and interests, and personalize your experience with the Services and our communications;
  • Communicate with you about the Services, including by sending announcements, updates, security alerts, and support and administrative messages; and
  • Provide support for the Services, and respond to your requests, questions, and feedback.

For research and development. To analyze and improve the Services and to develop new products and Services, including by studying use of our Services.

For marketing. We may send you marketing communications, including via email or SMS, notifying you of special promotions and offers. You may opt out of our marketing communications as described in the “Opt out of marketing communications” section below.

For compliance and protection. We may use personal information to:

  • Comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
  • Protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  • Audit our internal processes for compliance with legal and contractual requirements and internal policies;
  • Enforce the terms and conditions that govern our Services; and
  • Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

To create anonymous data. To create anonymous data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve our Services and promote our business.

How we share personal information

Directed disclosure to customers whose products you test.After joining MESH01, you may choose to participate in testing our customers’ products. By participating in a product test, you direct us to share your test results with the company whose product you test.

We may also share personal information with:

Service providers. Companies and individuals that provide services on our behalf or help us operate our Services or our business (such as hosting, information technology, customer support, email delivery, and website analytics services).

Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

Business transferees. Acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, MESH01 (including, in connection with a bankruptcy or similar proceedings).

Your choices

Access to information. If you have registered for an account with us, you may review and update certain personal information in your account profile by logging into the account.

Deactivating your account. You can deactivate your account at any time by logging into your User Dashboard, navigating to Profile and toggling the “Available to Test” button off.

Deleting your account. You can delete your account at any time by emailing privacy@MESH01.com from the email account you provided, and specifying your username.

Opt out of marketing communications. You may opt out of marketing-related communications by following the opt out or unsubscribe instructions contained in the marketing communications we send you or by contacting us at privacy@MESH01.com. You may continue to receive service-related and other non-marketing emails.

Online tracking opt-out. There are a number of ways to limit online tracking, which we have summarized below:

  • Blocking cookies in your browser. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. For more information about cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit www.allaboutcookies.org.
  • Using privacy plug-ins or browsers. You can block our websites from setting cookies by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block cookies/trackers.
  • Google Analytics. We use Google Analytics to help us better understand how people engage with the Services by collecting information and creating reports about how users use our Services. Note that because these opt out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Our Services may contain links to websites and other online services operated by third parties. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be integrated into web pages or other online services that are not associated with us. We do not control websites or online services operated by third parties, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and sharing of your personal information. We encourage you to read the privacy policies of the other websites and online services you use.

Security practices

We are committed to ensuring that your information is secure. Our platform and community are built and run in ISO27001 and SOC2 accredited application servers and data centers, and we employ reasonable technical, organizational and physical safeguards designed to protect the personal information we collect. Unfortunately, data transmission over the Internet cannot be guaranteed as completely secure. Therefore, while we strive to protect your personal information, we cannot guarantee the security of personal information.

Children

The Services are not intended for use by children under 18 years of age. If we learn that we have collected personal information through the Services from a child under 18 without the consent of the child’s parent or guardian as required by law, we will delete it.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on our website.

Additional information for users located in California

This section applies only to California residents. For purposes of this section, “personal information” has the meaning given in the California Consumer Privacy Act of 2018 (“CCPA”) but does not include information exempted from the scope of the CCPA. Specifically, this section does not apply to personal information pertaining to individuals acting as business representatives, rather than in their personal capacity.

We do not sell personal personal information. When you agree to participate in one of our customers’ product tests, you direct us to disclose your personal information to that company.

Your California privacy rights.

The CCPA grants individuals whose information is governed by the CCPA the following rights:

  • Information. You can request information about how we have collected and used your personal information during the past 12 months. We have made this information available to California residents without having to request it by including it in this Privacy Policy.
  • Access. You can request a copy of the personal information that we have collected about you during the past 12 months.
  • Deletion. You can ask to delete the personal information that we maintain about you.

You are entitled to exercise the rights described above free from discrimination.

Please note that the CCPA limits these rights by, for example, prohibiting businesses from providing certain sensitive information in response to an access request and limiting the circumstances in which they must comply with a deletion request.

How users in California can exercise their rights

  • Right to information, access, and deletion. You can request to exercise your information, access, and deletion rights by emailing privacy@mesh01.com or submitting a form here.
  • Identity verification. We will need to confirm your identity and California residency to process your requests to exercise your information, access or deletion rights. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
  • Authorized agents. California residents can empower an “authorized agent” to submit requests on their behalf. We will require the authorized agent to have a written authorization confirming that authority.

The information provided in this section applies only to individuals in Europe.

Controller. MESH01 is the controller of your personal information covered by this Privacy Policy for purposes of European data protection legislation.

Legal basis for processing. We use your personal information only as permitted by law. Our legal bases for processing the personal information described in this Privacy Policy are described in the table below.

Data protection representative. We have appointed VeraSafe as our representative in the European Union and the United Kingdom for data protection matters, pursuant to Article 27 of the General Data Protection Regulation.
